5. Facial Recognition and Biometric Data
Peasier offers optional facial recognition features that process biometric data, which is considered Special Category Data under GDPR and NDPR. This feature is disabled by default and requires explicit configuration to enable. When you use cloud-based facial recognition, YOU (the photographer) are the Data Controller and are responsible for obtaining explicit consent from individuals whose facial data will be processed. Peasier acts solely as a Data Processor. For complete details on how facial recognition works, data storage, processing options, and your responsibilities, see our AI Terms of Service.
6. AI Auto-Tagging
We use AI to automatically identify and tag content in your images, such as scenes, objects, and activities. Your images are not used to train AI models. Auto-tagging is enabled by default but can be disabled in your workspace settings. For complete details on how auto-tagging works and your options, see our AI Terms of Service.
7. How Do We Share Your Information?
We do not sell your personal information. We share your information only in the following limited circumstances:
Third-party Service Providers: We share your information with third-party service providers who help us deliver our Services. We only share information necessary for them to complete the service and require them to use it in accordance with this policy. Examples include hosting services (AWS), email delivery (Zoho Zepto), payment processors (Paystack, Stripe), and AI providers for auto-tagging (OpenAI, Anthropic, Google AI). Facial recognition is processed exclusively on our own servers. See our Data Processing Agreement for the full list of sub-processors.
On Your Instructions: We share and disclose personal information on your instruction, such as when you grant clients access to galleries or send email notifications through our platform, provided they are part of the functionality of our Services and comply with applicable law.
Change in Business: In the case of a merger, acquisition, financing, reorganization, or sale, information collected may be shared on the basis that it is subject to standard confidentiality arrangements. We will notify you of any such change.
To Comply with the Law: Information may be disclosed if deemed necessary to comply with the law and court orders, to protect the rights of individuals, to enforce our Terms of Service, and to fulfill law enforcement requirements.
With Your Consent: We may share information for other purposes with your explicit consent.

If you believe your privacy was not handled properly or become aware of any attempt to gain unauthorized access to your data, please contact us at privacy@peasier.com. We will make reasonable efforts to notify you and the appropriate authorities (if required by law) in the event of a security incident involving your personal data.
9. Data Retention
We retain your information for as long as your account is active or as needed to provide you with our Services. We may also retain and use your information to comply with legal obligations, resolve disputes, enforce our agreements, and protect our and others' interests. We may continue to store your information for a reasonable period after you cancel your subscription or become inactive, in case you wish to reactivate your account.
When you delete media, watermarked versions and facial recognition data are deleted immediately and permanently. As part of providing our Services, your personal information may be transferred to or accessed by third-party service providers located outside the EEA. We ensure all such transfers comply with applicable data protection laws and are completed using recognized mechanisms such as EU Standard Contractual Clauses (SCCs) or adequacy decisions by the European Commission. For details on our sub-processors and their locations, see our Data Processing Agreement.
11. Your Rights
You have certain rights regarding your personal data, including the right to access, correct, or delete your information. You may also request restriction of processing, object to processing based on legitimate interests, or request an export of your data. Where we process your data based on consent (such as marketing emails or cloud facial recognition), you may withdraw that consent at any time.
